FREQUENTLY ASKED

Common questions

Find answers to frequently asked questions, or contact us for more details.

What protection does design registration provide?

Registered designs protect the visual appearance (shape, patterns, colors) of a product. This prevents others from using designs that create the same overall impression.

How long does a registered design last?

Design protection typically lasts up to 25 years in Switzerland and the EU (with renewals every 5 years). Unregistered EU designs provide 3 years of protection automatically.

What is the grace period for designs?

The EU and Switzerland offer a 12-month grace period, allowing you to file within one year of first disclosure. However, we recommend filing before disclosure when possible.

Can I protect functional features with design rights?

Design rights protect appearance, not function. Features dictated solely by technical function cannot be protected as designs—consider patent protection for such aspects.

How quickly can I get a registered design?

Design registration is typically fast. Swiss designs can be registered in a few weeks, and EU registered designs often within days if filed electronically.
